Atlantic Pacific Inc. (“Atlantic Pacific,” “we,” “us,” or “our”) respects the privacy of website visitors, customers, business contacts, job applicants, drivers, and owner-operator applicants. This Privacy Policy explains what personal information we collect through our websites and online recruiting process, how we use and disclose it, and the choices that may be available to you.

Please read this Privacy Policy before submitting personal information. By using our websites, you acknowledge the practices described in this Privacy Policy. This acknowledgement is not consent where a separate, affirmative authorization is required by law.

Scope

This Privacy Policy applies to personal information collected through atlanticpacificinc.com, app.atlanticpacificinc.com, online contact and application forms, and related email or online communications initiated through those services. It also applies to information that we receive from service providers acting for us in connection with those online interactions.

This Privacy Policy does not replace any separate notice, disclosure, consent, release, or authorization required for background reports, FMCSA Pre-Employment Screening Program records, Drug and Alcohol Clearinghouse queries, drug and alcohol testing, biometric information, telematics, dashcams, electronic logging devices, direct deposit, or other employment or contractor processes. Those matters are governed by separate documents when applicable.

Personal Information We Collect

The information we collect depends on how you interact with us and the stage of any recruiting or business relationship.

Information you provide directly

1. Contact information, such as your name, email address, telephone number, mailing address, and the contents of your message or inquiry.
2. Applicant and recruiting information, such as work history, qualifications, availability, references, employment preferences, and information contained in a resume, application, or supporting document.
3. Driver and credential information, such as commercial driver’s license details, medical-card status, endorsements, driving experience, equipment information, and other qualifications relevant to a driver or owner-operator position.
4. Compliance and screening information, such as information needed for motor vehicle record, safety-performance, PSP, Clearinghouse, drug-testing, background-screening, or employment-verification processes, but only subject to the separate notices and authorizations required by applicable law.
5. Identification, tax, payment, or banking information that may be requested at a later onboarding stage when legally and operationally necessary. We do not request Social Security numbers or banking information through the public contact form.
6. Any other information you choose to provide to us.

Information collected automatically

When you visit or use our websites, our systems and service providers may automatically collect:

7. internet protocol address and approximate location derived from it;
8. browser type, device type, operating system, language, and similar technical information;
9. pages visited, links selected, referral information, timestamps, session activity, and error or security logs; and
10. cookie identifiers and similar information used to operate, secure, and troubleshoot the websites.

Information from other sources

Where permitted and after obtaining any required authorization, we may receive information from former employers, references, government or regulatory systems, motor vehicle agencies, FMCSA-related systems, consumer reporting agencies, drug and alcohol testing providers, medical review officers, insurers, customers, recruiting providers, public records, and other sources relevant to the requested service or position.

How We Use Personal Information

We may use personal information to:

11. operate, maintain, secure, and improve our websites and online services;
12. respond to inquiries and communicate about our transportation services, driver opportunities, applications, or support requests;
13. create and administer applicant or user accounts and send verification codes;
14. evaluate qualifications, process applications, schedule interviews or orientation, and make recruiting, employment, or contracting decisions;
15. verify identity, credentials, experience, safety history, eligibility, and legal or regulatory qualifications;
16. comply with transportation, safety, employment, tax, recordkeeping, and other legal obligations;
17. protect our company, drivers, customers, equipment, systems, and other persons from fraud, misuse, security threats, and unlawful activity;
18. establish, exercise, or defend legal claims and enforce contracts or policies;
19. perform analytics and troubleshoot website performance; and
20. carry out another purpose disclosed when the information is collected or with your direction or consent.

Cookies and Similar Technologies

Our websites use necessary session technologies to maintain functionality, security, and form or account sessions. Third-party content embedded in our pages, such as map services, may receive technical information, including an IP address and device information, and may use cookies or similar technologies under the third party’s own privacy terms.

As of the Effective Date, our websites are not intended to use personal information for cross-context behavioral advertising. If we later introduce advertising pixels, nonessential analytics, or similar tracking, we will update this Privacy Policy and provide any consent or opt-out mechanism required by applicable law.

Some browsers offer a Do Not Track setting. Because there is no uniform industry standard for responding to Do Not Track signals, our websites do not currently respond to them. Where applicable law requires recognition of a legally valid browser-based opt-out preference signal, such as Global Privacy Control, we will process that signal as required.

How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described above:

Recruiting, safety, and compliance recipients, including former employers, references, motor vehicle agencies, FMCSA-related systems, testing providers, medical review officers, consumer reporting agencies, insurers, and other recipients involved in a legally authorized qualification or onboarding process.
23. Customers and operational partners, but only when reasonably necessary for an assignment, orientation, site access, safety, insurance, or the performance of a transportation relationship.
24. Government authorities and legal recipients when disclosure is required or permitted by law, subpoena, court order, regulatory request, safety obligation, or to protect rights, property, or persons.
25. Transaction parties and advisers in connection with a merger, financing, reorganization, sale, transfer, bankruptcy, or similar corporate transaction, subject to appropriate confidentiality and legal safeguards.
26. Other persons at your direction, with your consent, or as otherwise disclosed when the information is collected.

Atlantic Pacific does not sell personal information for monetary consideration. Atlantic Pacific does not knowingly share personal information for cross-context behavioral advertising. If these practices change, we will update this Privacy Policy and provide any legally required opt-out method before the change applies.

Applicant and Driver Information

Information submitted by an applicant may be used to evaluate the individual for the position applied for and for other positions that may reasonably match the individual’s qualifications, unless the individual asks us not to do so. If an applicant is hired or enters a contractor or owner-operator relationship with us, relevant information may become part of the applicable personnel, driver-qualification, contractor, safety, payroll, or compliance records.

This Privacy Policy is not a consumer-report disclosure or authorization under the Fair Credit Reporting Act, is not a PSP authorization, is not a Clearinghouse consent, is not a biometric written release, and is not consent to receive automated marketing calls or text messages. We provide and obtain those documents separately when required.

Retention

We retain personal information for no longer than reasonably necessary for the purpose for which it was collected, including to respond to an inquiry, administer an application or relationship, meet transportation and employment recordkeeping requirements, maintain security and business records, resolve disputes, enforce agreements, and establish or defend legal claims. Retention periods vary based on the type and sensitivity of the information, the status of the application or relationship, legal and contractual requirements, limitation periods, and operational necessity.

When information is no longer required, we will delete, destroy, anonymize, or otherwise dispose of it in accordance with applicable law and our record-management practices.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, acquisition, destruction, use, modification, or disclosure. We also require service providers handling protected personal information to maintain appropriate safeguards where required by law or contract.

No website, email, transmission, or storage system can be guaranteed to be completely secure. You should avoid sending Social Security numbers, banking information, medical information, passwords, or other highly sensitive information through the public contact form or ordinary email unless we specifically instruct you to use an approved secure method.

Your Privacy Rights and Choices

Depending on your state of residence and the law applicable to Atlantic Pacific, you may have the right to request access to personal information we hold about you, request correction or deletion, obtain a portable copy, or opt out of certain sales, sharing, targeted advertising, or profiling. You may also have the right to appeal a refusal to act on a request and to be free from unlawful discrimination for exercising a privacy right.

Please state that your message is a “Privacy Request” and identify the state in which you reside. We may request information reasonably necessary to verify your identity and authority. We will use verification information only for that purpose and will respond within the time required by applicable law.

An authorized agent may submit a request where permitted by law. We may require proof of the agent’s authority and may need to verify your identity directly. Certain information may be exempt from a request, including information that we must retain for legal, safety, security, recordkeeping, claims, or other permitted purposes.

California, Delaware, and Nevada Disclosures

For residents of states with website privacy or comprehensive privacy laws, the categories of personal information collected, the categories of third parties to which information may be disclosed, our purposes, our tracking disclosures, and the effective date are described in this Privacy Policy. California residents who are employees, applicants, contractors, or business contacts may exercise applicable rights if Atlantic Pacific is subject to the California Consumer Privacy Act for the relevant period. Nevada consumers may use the Contact Us methods as the designated request address for any applicable request not to sell covered information. Atlantic Pacific does not currently sell covered information as that term is defined under Nevada law.

Children’s Privacy

Our websites and services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information online from children under 13. If we learn that a child under 13 submitted personal information through our websites, we will take reasonable steps to delete it, unless retention is required by law.

Third-Party Websites and Services

Our websites may contain links to or embedded content from third-party websites and services. Their privacy and security practices are governed by their own terms and policies. Atlantic Pacific is not responsible for the privacy practices of a third party that is not acting as our service provider.

Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our websites, business practices, service providers, or legal obligations. We will post the updated version on our website and revise the Effective Date. If a change is material, we may provide additional notice through the website, applicant portal, email, or another reasonable method, as required by applicable law.
